Terms of Use

These Terms of Use ("Terms") govern your access to and use of ArthaDynamics (the "Tool"). By accessing or using the Tool, you agree to be bound by these Terms. If you do not agree, do not use the Tool.

1. Nature of the Tool

ArthaDynamics is an educational mathematical simulation tool. It computes illustrative loan behaviour based on user-supplied hypothetical inputs using standard financial formulas.

2. What the Tool is NOT

The Tool is not, and does not hold itself out as:

• A financial advisor, investment advisor, or research analyst (as defined under SEBI regulations)
• A banking company, non-banking financial company (NBFC), or lending platform (as regulated by the Reserve Bank of India)
• An insurance intermediary, broker, or aggregator (as regulated by IRDAI)
• A direct selling agent (DSA), loan aggregator, or loan distribution service
• A product comparison, ranking, or review platform
• A credit bureau or credit scoring service
• A tax advisor, chartered accountant, or legal counsel

The Tool is not registered with, licensed by, or affiliated with SEBI, RBI, IRDAI, the Competition Commission of India (CCI), or any other regulatory authority — and is not required to be, because the Tool does not engage in any regulated activity.

3. No advice, no recommendations, no client relationship

Nothing produced by the Tool constitutes:

• Financial advice, investment advice, tax advice, or legal counsel
• A recommendation to take, prepay, refinance, restructure, or avoid any loan
• A recommendation regarding any specific lender, bank, NBFC, product, interest rate, or scheme
• A prediction or forecast of future interest rates, markets, or economic conditions
• A substitute for professional guidance from a SEBI-registered Investment Adviser, RBI-regulated financial institution, IRDAI-registered insurance professional, chartered accountant, or qualified legal professional

Use of the Tool does not create any advisor-client, fiduciary, professional, or contractual relationship between you and the operators of the Tool.

4. "As-is" provision; no warranties

The Tool is provided strictly on an "as-is" and "as-available" basis, without warranties of any kind — express, implied, statutory, or otherwise — including but not limited to warranties of accuracy, completeness, timeliness, fitness for a particular purpose, non-infringement, or uninterrupted availability.

Actual loan outcomes depend on lender-specific fees, policies, reset cycles, prepayment restrictions, tax treatment, market conditions, and contractual terms that the Tool does not and cannot know about.

5. User responsibilities

You are solely responsible for:

• The accuracy of inputs you enter
• Verifying all outputs against your lender's own calculations and your actual loan agreement before acting
• Consulting appropriately qualified professionals — including SEBI-registered advisors, chartered accountants, tax consultants, or legal counsel — for any decision with material financial impact
• Complying with all laws applicable to you and to your financial decisions

6. Limitation of liability

To the maximum extent permitted by applicable law, the operators of ArthaDynamics, including any contributors, shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to:

• Your use of, or inability to use, the Tool
• Any decisions made, actions taken, or not taken, based on the Tool's outputs
• Any errors, inaccuracies, or omissions in the Tool's computations
• Any unavailability, interruption, or modification of the Tool
• Any third-party services referenced, linked, or embedded in the Tool (including analytics and feedback services)

This limitation applies regardless of the legal theory under which liability is asserted, and whether or not the operators were advised of the possibility of such damages.

Nothing in this section is intended to, or shall, exclude or limit liability that cannot be excluded or limited under applicable Indian law, including mandatory consumer protection rights.

7. Indemnification

You agree to indemnify and hold harmless the operators of ArthaDynamics from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of your use of the Tool, your violation of these Terms, or your violation of any applicable law.

8. Intellectual property

The ArthaDynamics product — including its simulation engine logic, interface design, visual elements, and written content — is the intellectual property of its operators and is protected by applicable copyright and related laws. The Tool is made available for personal, non-commercial educational use only. Any reproduction, redistribution, reverse-engineering, or commercial exploitation of the Tool or its components is prohibited without prior written consent.

9. Third-party services

The Tool may load or reference third-party services (such as Google Analytics and Google Forms). Use of those services is subject to the respective third parties' own terms and privacy policies. The operators of ArthaDynamics are not responsible for the practices of those third parties.

10. Changes to the Tool and these Terms

The operators may modify, suspend, or discontinue the Tool at any time, in whole or in part, without notice. These Terms may also be updated from time to time. Continued use of the Tool after updates constitutes your acceptance of the revised Terms.

11. Consumer protection and statutory rights

The operators of ArthaDynamics acknowledge the Consumer Protection Act, 2019 and related consumer rights under Indian law. Nothing in these Terms is intended to waive, limit, or exclude any non-waivable statutory rights a user may have as a consumer.

However, users are reminded that:

• The Tool is offered free of charge and without commercial consideration from users
• The Tool does not sell, deliver, or promise any goods or services to the user
• The Tool does not constitute a regulated financial product, financial service, or financial advice under SEBI, RBI, IRDAI, or any other regulator's definition
• Use of the Tool does not establish a consumer-provider, advisor-client, fiduciary, or contractual commercial relationship

Any grievance a user may have regarding the Tool should, in the first instance, be raised through the feedback mechanism linked on the main page, so the operators have a fair opportunity to respond and resolve it before any external proceedings are initiated.

12. No liability for regulatory or third-party actions

The operators of ArthaDynamics make no representation that the Tool is appropriate, lawful, or available for use in any specific context, industry, or third-party arrangement. Users accessing the Tool do so on their own initiative and are responsible for compliance with all applicable laws in their jurisdiction.

The operators shall not be liable for:

• Any administrative, civil, criminal, or regulatory action brought against a user arising from how that user interprets or acts upon the Tool's outputs
• Any third-party action, complaint, or proceeding (including Public Interest Litigation or similar statutory actions) directed at the user based on the user's independent decisions
• Any outcome resulting from the user's reliance on outputs in dealings with banks, lenders, tax authorities, regulators, or any other third party

The Tool is a mathematical educational aid; responsibility for all real-world financial actions remains entirely with the user.

13. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or your use of the Tool shall be subject to the jurisdiction of the competent courts in India.

You agree to use the Tool in compliance with all laws applicable to you in your jurisdiction within India.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and the operators of ArthaDynamics concerning your use of the Tool.

16. Future commercial features

The operators reserve the right to introduce paid features, advertising, or referral relationships in future versions of the Tool. Any such features will be:

• Clearly disclosed before use
• Governed by additional terms specific to those features
• Subject to any additional regulatory requirements applicable at the time (including but not limited to ASCI advertising guidelines, RBI digital lending guidelines, SEBI advisory regulations, and DPDP Act provisions on personal data)

Continued use of the Tool after introduction of commercial features constitutes acceptance of the applicable additional terms for those features.
